General Terms and Conditions
I. Basic Provisions
These Terms and Conditions (hereinafter referred to as the “Terms”) are issued by Romana Jokešová, Company ID No.: 06126081, with registered office at Kurzova 2222/16, Prague 5, 155 00 (hereinafter referred to as the “Seller”), pursuant to Section 1751 et seq. of Act No. 89/2012 Coll., the Civil Code of the Czech Republic.
These Terms and Conditions govern the rights and obligations of the Seller and the Buyer when concluding a purchase agreement through the Samira Bags online store. All orders are intended exclusively for buyers acting as consumers, not as business entities.
II. Goods and Prices
Product Characteristics
Samira Bags offers original, custom-made handbags characterised by handcrafted production, high-quality materials, unique design, and the exclusivity of each individual piece.
Personalised Products
Samira Bags handbags are made to order according to the individual requirements of the Buyer. The Buyer acknowledges that goods made to order according to their specific wishes cannot be returned pursuant to Section 1837(d) of the Czech Civil Code.
Prices
The prices of goods are determined based on the Buyer’s requirements and are stated including VAT. The Buyer will receive a preliminary price calculation after providing their specifications.
Discounts
All discounts are mutually exclusive unless stated otherwise.
Gift Vouchers
Gift vouchers are valid for one year from the date of issue and include the name of the Buyer and the expiry date.
III. Ordering and Conclusion of the Purchase Agreement
Ordering Process
Orders are placed via a form on the website. Based on the order request, the Seller will send a price quotation, which the Buyer confirms.
Payment of the Order
The Buyer is required to pay a deposit of 60% of the total price of the goods to the Seller’s bank account. After completion of production, the Buyer pays the remaining balance, after which the goods are shipped.
Formation of the Agreement
The purchase agreement is concluded upon confirmation of the order by the Seller and receipt of the deposit payment.
IV. Delivery Terms
Production and Delivery Time
The production time for goods is approximately 3–5 working days. After completion of production, the goods will be delivered within approximately 2–3 working days within the Czech Republic and neighbouring countries. Delivery to other countries usually takes approximately 7–10 working days.
Delivery Costs
Shipping costs are paid by the Buyer. The Seller is not responsible for delays caused by the carrier.
Acceptance of Goods
The Buyer is obliged to check the integrity of the packaging upon receipt of the goods and immediately report any damage to the carrier.
V. Payment Terms
Payment Methods
Payment can be made by bank transfer. For international payments, PayPal or Revolut may also be used.
A deposit of 60% of the total order price is required to confirm the order. The remaining balance is payable before the handbag is shipped.
VI. Withdrawal from the Agreement
The Buyer acknowledges that, pursuant to Section 1837(d) of the Czech Civil Code, they cannot withdraw from the agreement because the goods are personalised products made according to the Buyer’s wishes.
Withdrawal from the agreement is only possible in cases of manufacturing defects or other reasons stipulated by applicable law.
VII. Rights from Defective Performance
Complaints Regarding Defective Goods
The Buyer has the right to claim defects in goods pursuant to Section 2099 et seq. of the Czech Civil Code.
Complaints must be submitted in writing by e-mail to designer@samirabags.com, including a detailed description of the defect in the handbag.
Complaint Period
The Buyer may exercise rights arising from defective performance within two years from the date of receipt of the goods.
Costs Related to Complaints
If a complaint is accepted, shipping costs are covered by the Seller. If the complaint is rejected, the Buyer covers the shipping costs.
VIII. Out-of-Court Dispute Resolution
For out-of-court resolution of consumer disputes, the competent authority is the Czech Trade Inspection Authority (Česká obchodní inspekce – www.coi.cz), which may be contacted in the event of a dispute between the Seller and the Buyer.
IX. Final Provisions
Applicable Law
The rights and obligations of the contractual parties are governed by the laws of the Czech Republic, in particular the Civil Code.
Effective Date
These Terms and Conditions become effective on 25 October 2024.
